Welcome to the Levity website and online services (‘Levity Site' or the ‘Site’), an online information, communications and e-commerce service provided by Levity Ventures LLC (‘Levity’ or ‘We’ or ‘Us’).

We respect your right to privacy. This privacy policy explains how we collect, use share and, most importantly, protect your information. Users may also wish to review policies specifically related to patient information (protected health information or PHI) in the Notice of Privacy Practices.

Purpose of Information Collection

By collecting user information, we are able to support important actions that support our operations and improve our service offering for clients. This can include:

Information collected automatically

The Levity site automatically collects user information which may include or be paired to personal data collected for third parties. We do so in order to improve our site experience and offer more personalized services.

 

As you interact with our Site, we may use cookies, pixels and web beacons, google analytics and Facebook Pixel to collect:

Device Information: Information about the device and internet connection from which you’re accessing our site, specifically your IP address, operating system, browser type and relevant version information

Usage Details: Details of your visits to our Site including, for example, such location, date and time of your visit, clickstream data, etc.

Location Data: Information about your location collected through Geolocation technology. Software employed by Levity may be able to collect and use geolocation information for the limited purposes. You may disable any of these functionalities at any time.

Information provided

We receive and store some information you enter on our Site or that you provide to us through the Site in any other way. Information collected, or that you provide, on or through our Site or by using our services includes:

  • Personal identification data (‘Personal Data’): This may include name, postal address, billing address, shipping address, e-mail address, home, work and mobile telephone numbers, age, date of birth, social security number, insurance policy number, physical characteristics that may personally identify you, sexual orientation, IP address, bank account number, credit or debit card number (for payment purposes only), national origin, ancestry, veteran or military status, medical conditions, race, citizenship, information about any physical or mental disabilities you may have, information related to your religious or philosophical beliefs, political opinions, information regarding your gender at birth and how you currently express your gender identity, information related to your sex life, such as pregnancy, child birth and related medical conditions, any history of criminal convictions, biometric information (such as fingerprints, exercise data, psychological characteristics, face prints, gait patterns, genetics, behavioral characteristics, voice, sleep data, and iris/retina scans), and genetic information (including familial genetic information)

  • Information provided in forms on our site (‘Form Data’): This includes, for example, meeting requests. It also includes information you provide when registering for service. We may also ask you for information when you report a problem with our Site. Some forms collect sensitive information, such as health information, necessary for service provision

  • Records and copies of correspondence: Should you contact us we will keep a record, including email addresses, to better meet your needs

  • Survey responses: Answers to questions we may ask to support Levity operations, research, etc.

  • Transaction data: Details of the payments and other transaction you may make through our Site

  • 'Posts:' if you at some point provide information to be displayed publicly (‘posted’) on the site, please note that you do so at your own risk; this applies to pages on which access is limited. We do not guarantee your posts will not be viewed by unauthorized persons.

Please note we may combine information collected with other data, including personal health information. If this is the case, we will treat all the information in question under the practices set forth in the Notice of Privacy Practices.​

Data Rights 

Non-client information

You can contact Levity at the information provided below to ask what information we may have of yours. You can notify us of any errors we may have in your personal data. In some cases, we may not be able to accommodate your request; this includes when it would violate any legal requirements or cause the information to be incorrect.

Client information

If you are a patient of Levity, you can access our Notice of Privacy Practices for detailed information on how we will protect, use and disclose your data.  ​

Data Retention

We will keep your data in our system for as long as required to comply with our legal obligations and resolve disputes and enforce agreements. You may request we delete your data by contacting us at the information provided below. However, please note we may not be able to honor your request given some legal requirements which require, for example, that we maintain medical record information. 

Data Disclosure

We may disclose the information we collect about you with third parties contracted to improve the site experience and our offering. This includes contracted parties who support our business operations by providing services such as IT and infrastructure support services, advertising, marketing, and payment processing services. We may also provide third parties with aggregate statistics regarding site visitor information in an aggregated fashion. 


In the case we work with a third party to support our advertising and marketing efforts, they will be required to agree to protect your data and comply with our privacy practices. 


Some additional scenarios may also lead to us disclosing users’ personal include: 

  • To fulfill the purposes for which the information was provided;

  • For any other purpose disclosed when the information is provided;

  • To request and collect payments;

  • To comply with our Terms of Use and other agreements;

  • To affiliates interested in marketing their products or services to you if you have purchased one of our products; only in the case you have not opted out of these disclosures; or

  • Merger, divestiture, restructuring, reorganization, dissolution, or other sale or transfer of some or all of our assets, whether as a going concern or as part of bankruptcy, liquidation, or similar proceeding, in which Personal Data held on our Site is among the assets transferred​

Disclosure Preferences

You can make choices regarding the ways in which we use your personal data by adjusting cookie settings. In addition, you can also opt out of email subscriptions at any time by clicking unsubscribe at the bottom of these communications or contacting us at the information provided below. If you wish to unsubscribe from affiliate programs, you can do so also by clicking unsubscribe at the end of any relevant email you receive from them or by emailing us.


Please note Levity ensures all sponsors and advertisers agree to avoid collecting any personally identifiable information from Site visitors. However, they may aggregate information collected with information from their own customers for their own purposes. We do not control how third parties use cookies and manage information collected through cookies. 

Email and Other Related Services 

  • Subscriptions: Our site may provide you with the opportunity to receive communications from Levity or other third parties. You may at any time also opt out of these opportunities by unsubscribing. 

  • Email via on-site links: Emails you send to us via email links may be shared with business administrators, program coordinators, health professionals or other Levity personnel or relevant contractors. Please note that these emails are not encrypted and are deleted after responding. We encourage the use of direct communication through our general contact information. 

  • Surveys: We may survey site visitors to improve our offering. You may deny providing any information requested, especially personally identifying information. Collected information is aggregated and anonymized and may be shared with contracted parties who have agreed to keep all data confidential and in line with the Levity Notice of Privacy Practices.

Security

Levity uses HIPAA compliant software to collect and store all patient information and has taken reasonable steps to ensure the integrity and confidentiality of your personally identifiable information provided to us. However, Levity cannot guarantee the security of any information you transmit, and you do so at your own risk.  

Protecting Children's Privacy

Our Site is not intended for users under 18 years of age. No one under age 18 may provide any information to or through the site, including name address telephone number, etc. We do not knowingly collect Personal Data from users under 18. Should we learn that data from a person under the age of 18 has been collected, we will delete that information. 

Links to Other Websites

Our Sites link to other websites with their own privacy policies which should be reviewed by users.  ​

Privacy Policy Updates

Levity will likely need to update its Privacy Policy as the company grows and rules and regulations change. Should we make significant changes, we will post as such on our forums.  

California Residents

You may ask us to disclose what personal information we have about you and what we do with that information, to delete your personal information and not to sell your personal information. You also have the right to be notified, before or at the point at which Levity collects your personal information, of the types of personal information we collect and what we may do with that information. We will not discriminate against users for exercising their rights and will make you waive these rights.  

Users in the European Economic Area (EEA), the United Kingdom (UK) and Switzerland

For resident of the EEA, the United Kingdom, or Switzerland, the following information applies with respect to personal data collected through your use of our Site.

  • Purposes of processing and legal basis for processing: As explained above, we process personal data in various ways depending upon your use of the services. We process personal data on the following legal bases: (1) with your consent; (2) as necessary to provide the services; (3) to comply with our legal obligations; and (4) as necessary for our legitimate interests in providing the services where those interests do not override your fundamental rights and freedoms related to data privacy.

  • Transfers: We may store and process data in the United States or any other country in which we or our affiliates host facilities. We subject data transfers to countries outside the EEA, the UK or Switzerland or any international organizations to the appropriate safeguards.

  • Your rights: You are entitled to the rights under Chapter III of the EU General Data Protection Regulation, the United Kingdom General Data Protection Regulations and Data Protection Act 2018, or Section 2 of the Swiss Federal Act on Data Protection with respect to the processing of your personal data. These include the right to access and edit for corrections and request personal data deletion. We may require you provide us with personal information prior to accessing any records containing your information in order to verify your identity.
